Rynixlighting, Inc. (“Rynixlighting”) is committed to respecting the intellectual property rights of others and expects all users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the full text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, and pursuant to 17 U.S.C. § 512(c)(3), Rynixlighting will promptly address claims of copyright infringement reported to it involving content made available through the Rynixlighting service or any Rynixlighting website (the “Site”).

Notice of Alleged Infringement

If you are a copyright owner, authorized to act on behalf of one, or authorized to enforce an exclusive right under copyright, and you believe that material available on the Site infringes your rights, you may submit a formal infringement notice to Rynixlighting’s designated copyright agent. After receiving a valid notice, Rynixlighting may, at its discretion, remove or restrict access to the allegedly infringing material.

To ensure your notice is effective, please include the following:

A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved;

The exact location of the allegedly infringing material, including the URL or sufficient information to allow it to be located;

Your company name (if applicable), mailing address, telephone number, and email address;

The following statements in the body of your notice:

“I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”

“I declare that the information in this notice is accurate, and under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.”

Your full legal name and your physical or electronic signature.

Counter-Notification

If your content was removed or disabled and you believe this action was taken in error, or you believe you are legally entitled to use the material, you may submit a counter-notification to Rynixlighting’s copyright agent. Your counter-notice must include:

Your physical or electronic signature;

Identification of the material that has been removed or disabled and the location where it previously appeared;

Your name, address, phone number, and email address, along with a statement that you consent to the jurisdiction of the federal court in Alachua County, Florida, and that you will accept service of process from the party that submitted the original infringement notice.

Upon receipt of a valid counter-notification, Rynixlighting may forward it to the original complaining party and inform them that the material may be restored within ten (10) business days. Unless the copyright owner seeks a court order, the removed material may be reinstated after ten (10) or more business days following receipt of the counter-notification.

Repeat Infringer Policy

Rynixlighting maintains a strict policy against copyright infringement and violations of intellectual property rights. Rynixlighting may terminate access to the Site or services for any user determined to be a repeat infringer.

Rynixlighting reserves the right to establish and modify the standards by which repeat infringement is assessed. Where applicable law, including 17 U.S.C. § 512, defines the term “repeat infringer,” Rynixlighting will apply that legal definition as a minimum standard.

As a general guideline, any individual or entity for whom Rynixlighting has received two or more valid infringement notices may be considered a repeat infringer. All relevant facts and circumstances will be reviewed before determining whether to terminate access.

Regardless of whether access is terminated, Rynixlighting retains all rights to pursue legal and equitable remedies against alleged infringers or other parties who violate intellectual property rights. Except as expressly stated in this policy, Rynixlighting does not provide legal representation or indemnification to any user accused of infringement arising from use of the Rynixlighting website or services.
